Article 1
Purpose. To prescribe the principles, regulations, and measures for the implementation of the management of the Community Development Fund for Independent Power Producer (IPP) projects, integrating it with improving the lives of directly and indirectly affected people, enabling them to live better than before, and linking it with the poverty reduction plan, namely the government's "Three Builds" work, by constructing infrastructure in resettlement areas for directly and indirectly affected people, gradually linking it with local strategies and development plans, especially promoting and encouraging community participation and contribution to the development of electric power and energy projects, making them robust and comprehensively ensuring sustainability.
Article 2
Scope of Application. This Agreement applies to all independent power generation projects nationwide, including those approved at the central and local levels.
Article 3
Definition of Terms. 3.1 Community Development Fund for Independent Power Projects means funds provided by electric power energy development projects under the obligations of the concession contract, used to serve local development and the development of resettlement areas for people affected by the project. 3.2 Community Development means the development policies provided in terms of knowledge, capacity, professional skills, livelihood and income generation, as well as the use of funds to improve and construct infrastructure for the people within the project area and related parties. 3.3 Independent Power Project (abbreviated as IPP) means an electric power project or electric power business that is wholly owned by private entities or jointly invested by private entities and state enterprises, operated for profit, and independent of the state enterprise that is the main generator and supplier of electricity in the country. 3.4 Concession Contract means the contract signed between the project company or independent project developer and the government for the investment and development of electric power energy projects, with the government side represented by the Ministry of Planning and Investment and the Ministry of Energy and Mines. 3.5 Locality means the village, district, or province where the project is located.
